Dutch Verification against EU Law (certificate of lawful residence)
This is for non-EU family members (partners) of EU/EEA citizens. The Dutch immigration authorities (IND) have national immigration rules and regulations and those that comply with the European Union (EU) Freedom of Movement rights. The EU Freedom of Movement rights are more relaxed and fair than the national immigration requirements. Thus, if one of you has an EU/EEA nationality it makes sense to make use of this.
The EU national does need to have or get a job, or perhaps study, and/or have enough means for the family not to become a burden on the state. Sometimes (not normally for spouse or minor children) it is necessary to evidence that the family member is already (financially) dependent on the EU citizen.
The non-EU family member who requires an advance visa to travel into the country can get a free facilitating visa for this purpose. Note that some of the same evidence is required to get this visa.
We will interview you and work with you to advise you on how to collect evidence with respect to your EU Freedom of Movement rights and your relationship with your non-EU spouse, partner, parents, children, etc. With this evidence you can apply for a “verification against EU law” which in turn entitles the person to a residence permit with permission to live and work in the country.
