​For those who consider the Tjebbes verdict and proportionality test to get the Dutch nationality back I would like to warn people to get professional help. Let me explain. I was born in Canada and had the Canadian nationality through being born in the country, and the Dutch nationality through my Dutch immigrant parents. Even with work and residency in the Netherlands, ultimately, I did lose my Dutch nationality without realising it due to the so called 10 year clock. This was a Dutch government set date on April fools day in 2013, can you believe it! At the time I worked for a large company and was intending to move to Germany for work. But that couldn’t go ahead as I lost my nationality. When in 2019 I heard about the Tjebbes court verdict and the possibility to get my nationality back I applied for this. However, my application was refused. Partially because the officials didn’t consider all aspects, but also because I didn’t submit all the evidence needed. I was given the opportunity to appeal the decision. Upon which I learned about Habsburg Legal Services and asked them for help. I was immediately helped and supported in the preparation of my appeal. Including how to get an extension of time, which was indeed needed. The appeal was well prepared and looked much different to my initial application. It had the evidence needed and hurray, it was approved. I am finally Dutch again and also retrospectively as if I never lost it. ​Kris really made me feel like his only client.     I am British and married my Dutch husband over 45 years ago.
    We have lived in the U.K. for about 40 years. He has Windrush status to remain in U.K. indefinitely
    I would love to have Dutch nationality. What do I need to do please?

    1. You could qualify for Dutch nationality while remaining British if you have been married over 3 years, and have lived together the last 3+ years. However, you can’t apply for this in as long as you are resident in the country of your current nationality (UK). However, you should realise that you do have continued EU Freedom of Movement rights as the spouse of a Dutch/EU national. Thus there are reasonable possibilities if you consider moving.
